The Arcananow App is managed by Red Room (hereinafter referred to as "ArcanaNow"). These Terms and Conditions of Use ("Terms") establish the agreement under which we may offer you the use of the Arcananow App and our associated services.

These Terms may be updated periodically. Any changes will be published in the ArcanaNow App.

If you have any questions about these Terms, please contact our support team at redroomtheapp@gmail.com. The Arcananow App offers its services exclusively based on these Terms. Contact details and a contact form for further inquiries can be found in the Contact section of our App.

1. Scope

These Terms apply to all users of the Arcananow App (hereinafter referred to as "you" or "user"). The Arcananow App will not be offered under any terms other than those stated in these Terms and Conditions unless otherwise agreed in writing with you.

Your order will be accepted by us when we process your payment information and make the Arcananow App available to you, at which point a subscription contract will be established between you and us.

2. Your Agreement with Arcananow

The use of the Arcananow App is not intended for individuals under the age of 18. If you are under 18, you are unfortunately not permitted to use the Arcananow App.

To use the Arcananow services, you must (1) meet the age requirements, (2) be authorized to enter into a legally binding contract with us and not be prohibited from doing so by applicable laws, and (3) be located in a country where our service is available. Please check the platforms where the ArcanaNow App is distributed to see if our service is available in your country.

Arcananow will provide its complete services to you as soon as you subscribe to the Arcananow App (see section 2.2). To create a Arcananow user account and subscribe to the Arcananow App, you must provide all the information requested in the registration form. By accepting these Terms and subscribing to the Arcananow App, you receive a simple and non-transferable right to use the Arcananow App in its current version. No separate declaration of acceptance is required from Arcananow. You must create an account personally, as we do not accept registrations made by third parties on your behalf. You are allowed to have only one ArcanaNow user account. We reserve the right to refuse your registration if we have reasonable cause or if we believe doing so could violate any applicable law or regulation. These Terms are only available in Spanish.

After downloading the Arcananow App, you can subscribe to the Arcananow App. Only after purchasing the paid subscription will you have full access to the contents and services of the ArcanaNow App (see paragraph 3). Without a subscription, you will have limited access to the content. This limited access includes reduced functionality as well as restricted reading of content limited to a variable number of messages over a certain period. Additionally, without a subscription, advertisements will appear. We may occasionally offer a paid subscription with a 3-day free trial period (see paragraph 2.4).

You can subscribe by following the steps indicated in the ArcanaYa App. ArcanaYa currently offers one type of subscription: weekly.

By subscribing, you agree that Arcananow may automatically charge the annual or weekly subscription fees using the payment method you provide until you cancel the subscription. To avoid being charged for the next subscription period, whether annual or weekly, you must cancel your subscription at least two (2) days before the automatic renewal date. Cancellation will only take effect at the end of your current billing period (or at the end of your free trial period), and you will continue to have access to your Arcananow account until then. We do not offer refunds for partially used billing periods.

The annual subscription amount will be charged in advance as a single payment. Subscription fees will be automatically renewed at the end of the respective subscription period unless you cancel your subscription at least two (2) days before the automatic renewal date.

The paid subscription fees are displayed in the Arcananow App. The fees must be paid in advance when subscribing to the Arcananow App. Payment methods vary depending on the country you are located in and are shown before subscribing.

Taxes will be included in the subscription price, and the amount may vary depending on the taxes applicable in each country.

Any banking fees caused by payments from your account will be your responsibility. If payment is not received using the payment method you provided, you agree to pay all amounts due upon our request.

Subject to your compliance with these Terms and the payment of applicable subscription fees, Arcananow grants you a limited, personal, non-exclusive, non-sublicensable, and revocable license to use the Arcananow App for non-commercial purposes.

You have the right to cancel your subscription within 3 days after first accepting these Terms or within 3 days after subscribing to the Arcananow App (during the free trial period). To exercise this right, you can notify us by sending an email to redroomtheapp@gmail.com or by completing the following cancellation form template:

Ordered on [subscription date], Consumer Name, Consumer Address, Consumer Signature (only if submitting this form on paper), Mobile or device model where the app was installed [---] Cross out what does not apply.

To comply with the cancellation period, it is sufficient to send your cancellation notification before the cancellation period ends. If you decide to cancel your subscription within the first 3 days, go to the subscription section of the platform where you downloaded the app and cancel the subscription.

You can cancel your subscription at any time, and the cancellation will take effect at the end of the subscription period. You must cancel your subscription at least two (2) days before the automatic renewal date. If you cancel your subscription after the first 3 days, you will still have access to the Arcananow App until your current billing period ends, as we do not refund or credit partially used billing periods.

You can cancel your subscription by canceling the automatic renewal of paid subscriptions in the app through the Apple iTunes Store or Google Play Store. To cancel or manage your subscription, go to the "Subscriptions" section in your iTunes Store or Google Play Store account settings and follow the respective procedure.

Uninstalling the app alone is not sufficient to cancel the subscription. You must follow these steps:

We may terminate your subscription at any time by notifying you if: (a) you have committed a material breach of any of these terms and fail to remedy the breach within 21 (twenty-one) days after we have informed you in writing of such breach; (b) you have overdue payments and do not settle them within 30 (thirty) days after we have reminded you to make the payment, or under such circumstances, please note that we may write to you to inform you that we will cease providing the Arcananow App as a subscription service. We will notify you at least 90 (ninety) days in advance that we will stop providing the service.

If you are canceling your subscription for one of the reasons listed below, the contract will terminate immediately, and we will refund you the full amount for any services you have paid for but not received. Such reasons are as follows: (a) we have suspended the supply of the Arcananow App for technical reasons or have notified you that we are going to suspend it for technical reasons, in either case for a period of more than 7 (seven) days; or (b) you have the legal right to terminate the contract because we have breached these Terms.

We offer the first 3 days of the subscription for free; this trial period will not be billed. You may only benefit from these 3 free days with your first subscription. Before you can use the subscription, you will be required to accept the Privacy Policy and Terms of Use and then enter your payment information (e.g., via Apple ID or Google Pay). By providing this information, you agree that we may start automatically charging the paid subscription fee on the fourth day after the trial subscription ends.

If you do not agree to be charged the subscription fee, you must cancel the subscription before the free trial period ends (see paragraph 2.3 above). If you cancel your subscription during the free trial period, you will automatically lose access to the Arcananow App at the end of your free trial period. If you cancel your subscription after the free trial period ends, you will continue to have access to the Arcananow App until the current billing period ends, as we do not refund or credit partially used billing periods.

Payment and subscription management is handled through Google and Apple, offering the highest possible guarantee of security when using your payment information.

The subscription prices and durations explained above are relative to the base subscription price.

From time to time, or for reasons we deem appropriate, Arcananow may offer certain promotions where prices may differ from the base prices. These offers will always be cheaper than the base prices.

3. Description of Services

The ArcanaYa app lets you perform card spreads in different arcana formats.

You can perform spreads and read interpretations, save favorites, access your history, and complete gamification missions.

4. Data Security

Arcananow will continuously update, expand, or modify the Arcananow App to respond to changing user interests, correct technical errors, and introduce new features. Therefore, we recommend that you keep the Arcananow App, your device software, and your operating system (e.g., with the latest security updates) up to date.

The content of this App is transferred between the Arcananow App on your device and Arcananow systems through a TLS/SSL connection. Arcananow does not store data from your bank transactions or the card used to subscribe. Arcananow reserves the right to periodically adapt the technical measures used to protect your data (e.g., due to technological advances).

We may contact you using various methods, including email. While all our emails are scanned for viruses, we recommend scanning any attachments, as we are not responsible for any loss or damage caused by software viruses. If you choose to contact us via email, please note that email communications without encryption may not be the most secure method, and third parties may access them. Arcananow is not responsible for such access. If you wish to ensure the security and confidentiality of any information sent to us via email, you should use encryption methods.

Arcananow provides the Arcananow App in its current version. You are not entitled to request that the Arcananow App be maintained in the state it was in when you accepted these Terms or at any later date. The Arcananow App is compatible with mobile devices running iOS or Android operating systems. ArcanaNow reserves the right to offer the Arcananow App only for specific operating systems and/or certain versions of operating systems. We recommend always keeping your operating system up to date.

We do not share your data with unauthorized third parties. However, this information may be shared with authorized third parties in certain cases, particularly when it is strictly necessary to provide and improve our services. We will not sell your data to third parties under any circumstances.

The Arcananow App may not work on all devices. Specifically, if you install the ArcanaNow App on a device with an operating system modified in a way that violates the manufacturer's or provider's requirements, including bypassing any restrictions without authorization (a "Modified Device"), it may not work, and you should not use it on such a device. We are not responsible for any loss caused by using the Arcananow App on a modified device or if the Arcananow App does not work properly or does not work at all in such cases. By using a modified device, you bear the burden of proving that a defect was not caused by the modification of the device.

We will need to perform planned and occasionally unplanned technical maintenance, during which you will not be able to use the Arcananow App.

We cannot guarantee that the use of the Arcananow App will be uninterrupted or error-free. As with most online services, we also cannot guarantee that the Arcananow App will be free of viruses or other malicious code, although we do our best to prevent this from happening. In case of any anomalies, please document them and send them to Arcananow in writing. The information you send us will help improve our service, among other things. Please report this to redroomtheapp@gmail.com. This does not affect your legal rights in the event that the products are defective or do not meet the description.

We may adjust the technical and organizational measures we use to protect your information (e.g., to implement technological advances), as long as this does not reduce the level of protection applied to your information.

5. Obligations of Arcananow

We have a legal obligation to provide you with services that comply with these Terms. Nothing in these Terms will affect the rights that legally apply to you.

Arcananow is committed to providing email support for inquiries. Arcananow will generally respond to your inquiries within 2 business days. Please note that depending on the nature and scope of your question, we may not be able to provide a response or solution within 2 business days.

6. User Obligations

You agree to:

• not attempt to access another person's account through the Arcananow App;
• not transfer or attempt to transfer viruses, trojans, worms, or other malicious code to our systems;
• not hack, reverse engineer, or manipulate our systems, or attempt to do so;
• not use the Arcananow App in a way that violates any law or regulation, or that could cause us to violate any law or regulation;
• not breach any contractual agreements with the providers of your account when using the Arcananow App; and
• keep your information up to date in the Arcananow App.

If we have reason to believe you are violating any of these Terms, we may temporarily suspend your access to the Arcananow App while we investigate further. Arcananow will inform you of the suspension of your account unless doing so would violate any of our legal obligations. If we determine that you have not violated these Terms, we will restore your access to the Arcananow App as soon as possible.

You are responsible for keeping your personal login information confidential and secure and protecting it from being accessed or used by third parties. You should not write it down or save it in a way that would allow others to access the Arcananow App. If any of the devices where you have installed the ArcanaNow App or where you may have backed up your data is lost or stolen, anyone in possession of the device could access your user account in the Arcananow App. It is your responsibility to contact us immediately in case of loss or theft, or if you become aware of any misuse or unauthorized access to your user account in the Arcananow App. You can contact our support team at redroomtheapp@gmail.com.

7. Our Responsibility

We are responsible for any loss or damage you suffer that is a foreseeable result of our breach of these Terms, except as excluded by this paragraph or elsewhere in these Terms. We are not responsible for any loss or damage considered unforeseeable. Loss or damage is foreseeable if it is obvious that it will happen or if both you and we knew it might happen when you accepted these Terms.

We are not legally allowed to exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors and for fraud or fraudulent misrepresentation, or when the Arcananow App fails to meet its purpose, is not of satisfactory quality, or is not as described. If you use the Arcananow App for any commercial or business purpose, we will not be liable to you for:

• loss of profits or anticipated savings;
• loss of business or business opportunities;
• any special, indirect, or consequential damage or loss.

8. How We May Modify the Arcananow App or These Terms

We may modify these Terms or change the Arcananow App for any of the following reasons:

• to add new features to the Arcananow App;
• to remove any feature or functionality;
• to reflect changes (including anticipated changes) in the law or regulation, including any decision by a court, regulator, or ombudsman;
• to reflect any changes in our costs of providing the Arcananow App; or
• to reflect any advancements in the technology we use or intend to use.

Since these Terms do not have an expiration date and we hope you use the Arcananow App for a long time, we may need to modify these Terms or the Arcananow App for a valid reason not mentioned above.

We will notify you about these modifications in the following ways:

• showing you any amendments the next time you access the Arcananow App and asking you to confirm that you accept the changes; or
• sending you information about the amendment by email. We will use the email address you provided. If we notify you about the amendment by email, we will try to give you at least 30 days' notice before the amendment takes effect.

If you do not wish to accept the amendment, you can terminate this agreement by sending an email to redroomtheapp@gmail.com within 30 days of receiving the email. Upon receiving such an email, ArcanaNow has the right to terminate this agreement before the changes take effect without prior notice, and as a result, your Arcananow user account will be deleted. The original terms and conditions will remain in effect until the agreement is terminated.

If you do not terminate this agreement beforehand, the amendment will take effect after the notification period (when notified by email) or immediately (when notified via the Arcananow App).

9. Other Relevant Terms

These Terms will be communicated in Spanish. These Terms and any dispute between you and us related to the use of the Arcananow App and our associated service, and/or these Terms, are governed and interpreted in accordance with the applicable laws as outlined in the relevant consumer protection regulations.

By accepting these Terms, you also agree to receive documents and statements from ArcanaNow related to the use of the Arcananow App in an electronic data format.

Included as part of our standard Services, and upon accepting these Terms, ArcanaNow also offers a free information service that allows you to receive email updates about the Arcananow App and related services and benefits. If you are not interested in this service, you can cancel it at any time. If you wish to unsubscribe from this service, you can do so by clicking the "Unsubscribe from newsletter" button in any ArcanaNow email. Alternatively, you can also contact our support team.

If you have any complaints about the Arcananow App, please give us the opportunity to resolve them by sending an email to redroomtheapp@gmail.com. We assure you that we take all complaints seriously.

You can also resolve a dispute online using the European Commission's Online Dispute Resolution Platform.
